Tender specifications are documents containing all the technical details relating to works and projects under procurement contracts. They define the characteristics of the service or construction contracted for, as established by the contract. Specifically, they contain details of the works, the construction methods, the materials to be used, and the requirements for proper execution.
Meaning of contract and technical specifications
The term “procurement” refers to the contract by which a person or company undertakes to manage a service or perform a work, assuming the risks involved.
Technical specifications are the set of documents attached to the tender notice, through which the contracting authority identifies the technical requirements to be applied to the subject matter of the previously stipulated contract.
Tender specifications: the types
Public works design involves several phases: feasibility study, preliminary and final design, and executive design. For the final two stages, a specific tender specification must be drawn up and attached to the contract.
General tender specifications
This document defines the most important terms of the contract and the contractual relationship between the principal and the contractor. It is governed by Ministerial Decree No. 145 of April 19, 2000, and its objective is to standardize the general terms and conditions of all contracts. It contains:
the choice of the contractor’s domicile;
the methods for designating the persons authorized to collect on behalf of the contractor;
the contractor’s rules for conducting work;
discipline and good order on construction sites;
contract registration and ancillary costs;
the procurement and provenance of materials;
the contractor’s responsibilities and obligations for construction defects;
the daily duration of the work;
the ownership of found objects and demolition materials.
Special tender specifications
The Special Tender Specifications, drawn up upon the actual signing of a contract, define the requirements for the works to be carried out, the characteristics of the materials used, and the methods of execution. They contain both an administrative section and a technical specification. The Special Tender Specifications are mandatory for public works, but not for private projects.
